11:51:17 AM County Attorney Marty Lambert Advice. Suggests editing 1.02.6 #3, page 4 to, "Will not adversely affect property in the neighborhood or district."
11:53:45 AM Commissioner Vincent I will move that we adopt Resolution #2005-069, a resolution of intention of the Gallatin County Commission to adopt the proposed South Cottonwood Canyon Zoning Regulation and Zoning Map. We would be in the relevant sections, deleting reference to the planning board, as we've discussed before, we would be deleting in the appropriate section reference to the Board of Adjustment. We would be changing the language in regard to adverse affect on property as stated into the record by the County Attorney Marty Lambert, I would find that the application for zoning complies with the Gallatin County Growth Plan, that it has received 76% support, noting that there were 12 folks that were non-committed and 2 that opposed, that it received 100% support from the committee members as a recommendation to forward to the County Commission, that it received a 7:2 vote on the Planning Board in support, that it allows for accommodation of commercial viable and growing commercial facility and that it strikes a reasonable, even a unique balance between preservation of the canyon resource, of the Cottonwood Canyon Resource and a commercial development.
